Penalties for Drug Manufacturing
Drug manufacturing is usually a felony that is punishable by imprisonment and a fine up to $50,000. Cases prosecuted in federal court could face much more severe punishment.
If you are convicted of offering to manufacture drugs then you face a felony punishable by probation and incarceration time.
There are additional penalties if drugs were manufacturing under the following circumstances.
Large Quantities of Drugs
If you were convicted of manufacturing or offering to manufacture large quantities of PCP, meth, or GHB then you face the following additional penalties:
- 3 years if the substance is more than 3 gallons of liquid by volume or one pound of solid by weight
- 5 years if the substance is more than 10 gallons of liquid by volume or 3 pounds of solid by weight
- 10 years in the substance is more than 25 gallons of liquid by volume or 10 pounds of solid by weight
- 15 years in the substance is more than 105 gallons of liquid by volume or 44 pounds of solid by weight
If Injury or Death Occurs
If you are manufacturing or attempting to manufacture meth or PCP and it causes great bodily injury or death to someone other than your accomplice, then you face an additional and consecutive one year in prison for each injury or death.
Manufacturing in the Presence of Children
If methamphetamine was being manufactured in the presence of a child under 16 then you face an additional 2 years in prison.
Prior Drug-Related Convictions
If you have a prior drug-related conviction such as possession for sale, transportation of controlled substances, or selling methamphetamine, then you face an additional 3 years for each felony conviction.
Legal Defenses for Drug Manufacturing
If you haven’t started the actual manufacturing of a drug, only prep work, then you can’t be charged with drug manufacturing.
Police have to have a valid California search warrant or probable cause in order to search you or your property. If they search you or your property with a valid search warrant, without probable cause, or search outside the boundaries of the search warrant, then it can be used a defense.
Perhaps you were going to a house to buy drugs when police were searching the area. While drug use and possession are still illegal, those are not as serious as drug manufacturing.
