What Does it Mean to Transport or Distribute Methamphetamine?

It is illegal under Health and Safety Code 11379 to:

  • Sell or exchange methamphetamine for money, goods, services, or anything of value
  • Transport methamphetamine from one location to another with the intent to sell or distribute it
  • Distribute methamphetamine or provide it for other people
  • Administer methamphetamine to someone else
  • Attempt to do any of the above

In order to be guilty of transportation or distribution of methamphetamine, the following have to be proven:

  • The defendant engaged in one of the above activities
  • The defendant knew that there were drugs present and knew of their nature as a controlled substance
  • The defendant sold or transported a usable amount of methamphetamine

Penalties for the Transportation/Distribution of Methamphetamine

The transportation and distribution of methamphetamine is a felony under Health and Safety Code 11379 HS. The penalties include:

  • Incarceration time, or
  • A fine up to $10,000

If you distribute methamphetamine across 2 or more county lines the imprisonment sentence increases.

There is an additional year in jail if you distribute methamphetamine within 1,000 feet of a drug treatment center, a detox facility, or a homeless shelter.

If you’re distributing or transporting more than one kilo of methamphetamine you face an additional 3 to 15 years of imprisonment.

Cases prosecuted in federal court could face much more severe punishment.
