Are Hallucinogenics like LSD, Ecstasy and Magic Mushrooms Legal in CA Now?
The California Senate, Public Health Committee, and Assembly Health Committee all have approved SB-58, so are hallucinogenics like LSD, Ecstasy and Magic Mushrooms legal in CA now?
Not yet. But, like cannabis before them, they may be in the future.
California Senate Bill 58
California Senate Bill 58 (SB-58) aims to decriminalize certain hallucinogenic substances for personal or facilitated therapeutic use by people 21 or older.
The current version of the bill would make psilocybin “magic” mushrooms, mescaline, and a few other controlled substances legal. However, synthetic psychedelics like LSD and MDMA (also known as Ecstasy) are not included and would still be illegal.
Peyote, while plant-based rather than synthetic, also is excluded from the legalized substances list proposed in AB-58.
If passed, there will be limits on the amounts of these drugs an individual can legally possess. For example, the “allowable amount” section of the bill prescribes the following psychedelics possession limits:
- DMT—2 grams
- Ibogaine—15 grams
- Psilocybin—2 grams, or up to 4 ounces of “a plant or fungi containing psilocybin”
- Psilocyn—2 grams, or up to 4 ounces of “a plant or fungi containing psilocyn.”
The next step for SB-58 is to get California Assembly approval.
California Assembly Bill 941
California Assembly Bill 941 (AB-941) is related to SB-58 but is much narrower in scope. AB-941 aims to legalize certain hallucinogenics for use in “psychedelic-assisted therapy” for combat veterans.
This bill would allow licensed clinicians to administer the controlled substances to veterans for the treatment of conditions such as post-traumatic stress disorder (PTSD), traumatic brain injury, or addiction.
LSD, Ecstasy, Magic Mushrooms, ketamine, and ibogaine are some of the controlled substances included in AB-941.
This bill is currently being reviewed by the Assembly Health Committee.
