What is a Hit and Run?

A misdemeanor hit and run, Vehicle Code 20002, is when someone leaves the scene of an accident without leaving their information or identifying themselves to the other people involved and another person’s property was damaged in the accident.

A hit and run becomes a felony, Vehicle Code 20001, when another person is injured in the accident.

In order to be guilty of a misdemeanor hit and run the following elements must be proven by the prosecution:

  • The defendant was involved in a car accident while driving
  • The accident was the cause of damage to someone else’s property
  • The defendant knew the someone else’s property was damaged or that it was probably that someone else’s property was damaged
  • The defendant intentionally left the scene of the accident without identifying him or herself

Penalties for a Misdemeanor Hit and Run

A misdemeanor hit and run includes the following penalties:

  • Up to 3 years of misdemeanor probation
  • Up to 6 months in a county jail
  • A fine up to $1,000 plus court-assesses penalties
  • Restitution to the victim(s) of whose property was damaged
  • Two points on your driving record

Penalties for a Felony Hit and Run

A hit and run becomes a felony when the victim or victims are physically injured. The penalties include:

  • A fine anywhere from $1,000 to $10,000
  • Up to 3 years in a California state prison
  • Up to 4 years in a California state prison if the accident was the cause of the victim’s death or serious bodily injury

Legal Defenses for a Hit and Run

If you were driving a car and hit someone else’s car but there was only damage done to your car, then you are not required to stop and exchange information.
