A misdemeanor hit and run, Vehicle Code 20002, is when someone leaves the scene of an accident without leaving their information or identifying themselves to the other people involved and another person’s property was damaged in the accident.
A hit and run becomes a felony, Vehicle Code 20001, when another person is injured in the accident.
In order to be guilty of a misdemeanor hit and run the following elements must be proven by the prosecution:
- The defendant was involved in a car accident while driving
- The accident was the cause of damage to someone else’s property
- The defendant knew the someone else’s property was damaged or that it was probably that someone else’s property was damaged
- The defendant intentionally left the scene of the accident without identifying him or herself
