Penalties for Insurance Fraud

The penalties for insurance depend on the amount and the type of insurance fraud committed.
As a misdemeanor

  • Imprisonment
  • A fine up to $10,000

As a felony

  • Imprisonment
  • A fine up to $50,000 or double the amount defrauded, whichever is greater
  • Restitution

For a felony insurance fraud charge involving worker’s compensation, the fine could increase to $150,000 or double the amount defrauded, whichever is greater.
If the defendant has prior felony convictions, the prison sentence can increase 2 years per offense committed.
Another possible penalty is restitution to the victim.
