Insurance fraud is when someone makes a false insurance claim in order to gain money on a false, exaggerated, or deliberate injury or loss.

The prosecution has to have the proof that the defendant had the intent to commit fraud. In order to be guilty of insurance fraud, the defendant has to take definitive steps to make claims that they didn’t have the right to.

Penalties for Insurance Fraud

The penalties for insurance depend on the amount and the type of insurance fraud committed.
As a misdemeanor

  • Imprisonment
  • A fine up to $10,000

As a felony

  • Imprisonment
  • A fine up to $50,000 or double the amount defrauded, whichever is greater
  • Restitution

For a felony insurance fraud charge involving worker’s compensation, the fine could increase to $150,000 or double the amount defrauded, whichever is greater.
If the defendant has prior felony convictions, the prison sentence can increase 2 years per offense committed.
Another possible penalty is restitution to the victim.

Legal Defenses for Insurance Fraud

False accusations happen when a boss, coworker, family member, etc get angry or jealous. It’s common for false accusations to happen with insurance fraud.

In order to be guilty of insurance fraud, you have to act with fraudulent intent. If you didn’t know you were committing fraud because of a mistake, then you can’t be guilty of it.

If the prosecution doesn’t have enough evidence to prove that you committed insurance fraud, then it could work as a defense.
